US EPA Finalises TSCA Rule on Multi-Walled Carbon Nanotubes

Summary

The US EPA has adopted a new Significant New Use Rule for certain multi-walled carbon nanotubes, requiring companies to notify the Agency before engaging in specified new activities. The measure is designed to allow EPA to evaluate potential risks and take action, where necessary, before new uses of the material are introduced.

The US Environmental Protection Agency (EPA) has issued a final Significant New Use Rule (SNUR) under the Toxic Substances Control Act (TSCA) for specific multi-walled carbon nanotubes (MWCNTs). The rule follows the Agency's earlier review of the substance through a premanufacture notice and a TSCA Order.

Under the SNUR, companies intending to manufacture, import or process the affected MWCNTs for designated significant new uses must notify the EPA before commencing those activities. This advance notification requirement enables the Agency to assess potential risks and, where necessary, impose measures to manage them before the proposed use begins.

The rule is intended to ensure continued regulatory oversight as the applications of carbon nanotubes evolve and expand. It will enter into force on 22 September 2026.
